  6. Limitation of Liability

      TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HIRING FUTURE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:

      • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
      • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
      • DAMAGES RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; (iii) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; (iv) ANY BUGS, VIRUSES, OR THE LIKE THAT MAY BE TRANSMITTED THROUGH OUR SERVICES; OR (v) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT
    2. Cap on Liability

      IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

      You agree to defend, indemnify, and hold harmless Hiring Future and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with:

      • Your violation of these Terms
      • Your violation of any third-party right, including without limitation any intellectual property, property, or privacy right
      • Any claim that your content caused damage to a third party
      • Your willful misconduct or gross negligence

      We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim. You agree not to settle any matter without our prior written consent.

  9. Governing Law and Dispute Resolution

    1. Governing Law

      These Terms shall be governed by and construed in accordance with the laws of the State of Qatar, without regard to its conflict of law provisions.

    2. Dispute Resolution

      Any dispute arising out of or relating to these Terms or our Services shall be resolved as follows:

      • Negotiation: The parties shall first attempt to resolve the dispute through good faith negotiations.
      • Mediation: If negotiation fails, the parties agree to attempt mediation through a mutually agreed mediator in Doha, Qatar.
      • Arbitration: If mediation is unsuccessful, the dispute shall be finally settled by arbitration in Doha, Qatar under the Qatar International Centre for Conciliation and Arbitration (QICCA) rules.

      The arbitration shall be conducted in English, and the award shall be binding and enforceable in any court of competent jurisdiction.

    3. Class Action Waiver

      YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

    4. Injunctive Relief

      Notwithstanding the above, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights or prevent unauthorized use of our Services.

      If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

    4. Assignment

      You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

    5. Force Majeure

      We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, or internet outages.

    7. Relationship of Parties

      Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Hiring Future.
